To whom it may concern:

 

My name is Mike Bingham.  I have been acquainted with Tom Green for at least twelve years.  I have had occasion to associate with him and his family dozens of times both in person and over the telephone.  I have no connection with him other than that I am a friend and share some of his views on Mormonism.

 

I am dismayed by his recent conviction because I know that he was only found guilty of bigamy because Juab County prosecutors were able to persuade Judge Donald Eyre to summarily pronounce Tom legally married to one of his lady-friends against their will.  The court was apparently so desperate to win a conviction, that it resorted to mingling elements of the bigamy statute and common-law marriage which are mutually exclusive.

 

It has come to my attention by way of another friend, (John Doe), (an ex-“plural husband” of the notorious hate-group leader [Tapestry Against Polygamy witch]) that Tom was accused of “hitting on” Mr. Doe’s thirteen year-old daughter (Doe) at a Green family picnic this summer, 2001.

 

I wish to state for the record (and am willing to testify under oath) that I, Mike Bingham, traveled to said picnic in Mapleton with the entire Doe family in their van.  Before dinner, the various families participated in numerous outdoor games, races and other activities, all of which I observed.  Doe supervised his children’s participation in the games.  At the conclusion of the recreational activities, I withdrew, along with Tom Green and a small group of Tom’s other friends, to a picnic table in the pavilion.  Tom shared his food and beverages with me, and we remained in conversation at length during and after dinner.  Mr. Doe’s children were situated some distance away at a different end of the pavilion where they ate their picnic dinner and socialized with other families. 

 

As dusk approached, I moved to the Doe’s table to observe the evening talent-show presentation.  The tables were rearranged into a half-circle and Tom remained on the other side of the pavilion with his children and friends.  From his position near the front, Tom participated from time to time in the talent activities.

 

I am prepared to testify that, between the moment of arrival and the moment of departure of the Doe family and myself, I never once observed Tom Green “hitting on” any of Doe’s adolescent daughters.  In fact, I did not observe him interacting, in any way whatsoever, with any of Doe’s children.  I understand from Mr. Doe that these fabricated allegations of impropriety did not surface until some months after the picnic.

 

If the source of the aforementioned allegations is [Ms. Tapestry Witch], then you must consider the source.  I have known her for ten years and know her to have a character of the basest quality.  This woman has had numerous children from several partners and has ruthlessly waged a vengeful campaign of persecution and defamation against her former husband and numerous other innocent families for doing nothing more than observing their religion according to the dictates of their conscience.  She has done the very same thing for which Tom Green now sits in prison (to wit - having multiple concurrent spouses and openly professing so).  It is remarkable to me that the State would continue to allow [Ms. Tapestry Witch] to retain custody of Mr. Doe’s children, when, for nine years, she has repeatedly prevented them from associating with their father.  She has made a full-time profession out of lies and false accusations.  Now she has gone so far as to enlist her own children and the State’s precious resources in her ever-escalating witch-hunt.
